1. Introduction
Welcome to CollectiveAccessForum ("we," "our," or "us"). These Terms & Conditions ("Terms") regulate your use of our yacht charter services and the website available at collectiveaccessforum.sbs (the "Service") managed by CollectiveAccessForum.
By reserving a charter or using our Service, you consent to these Terms. Should you not agree with any section of these terms, you are prohibited from using the Service.
2. Service Overview
CollectiveAccessForum offers a range of luxury yacht charter services including:
- Yacht rentals for the day
- Evening yacht tours
- Company team-building retreats
- Exclusive gatherings
- Extended yacht charters
All offerings are provided based on the yacht’s availability and weather conditions. We retain the right to adjust or cancel services at any point without prior notice.
3. Booking and Reservations
3.1 Booking Process
For charter reservation, you must:
- Be of legal age, at least 18 years old
- Provide valid and accurate details
- Make an initial deposit as outlined in your reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A confirmed booking occurs only after payment is received and we have sent a written acknowledgment. We have the full authority to decline services to any individual at our discretion.
3.3 Availability
Our charters depend on the availability of the vessels and favorable weather conditions. We strive to meet your scheduling preferences to the best of our ability.
4. Payment Terms
4.1 Pricing
All fees are stated in € and include all applicable taxes unless indicated otherwise. Fee amounts are subject to modification without prior notice.
4.2 Payment Schedule
- Deposit: Half of the overall cost of the charter required at the time of booking
- Final Amount: Payable 48 hours prior to the charter's departure
- Extra charges (if applicable): Payable upon the charter’s completion
4.3 Payment Methods
Accepted methods of payment include major credit cards, direct bank transactions, and certified bank drafts. Our payment processing utilizes encrypted systems for security.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Cancellations made over 72 hours before departure: The full amount is refundable minus any processing expenses
- Cancellations between 24-72 hours before departure: Half of the amount is refundable
- Cancellations less than 24 hours before departure: The amount is non-refundable
5.2 Weather Cancellations
Should our captain consider weather conditions to be unsafe, the following options will be provided:
- Reschedule the charter to another suitable date without any additional charges
- Issue a complete refund if an alternative date cannot be arranged
5.3 Mechanical Issues
In case of technical difficulties with the designated vessel, we will attempt to arrange an appropriate substitute. If substitution isn’t feasible, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Obey all instructions given by the crew
- Don safety gear when instructed
- Inform us of any medical conditions that may impact their safety
- Stay within the designated areas aboard the vessel
6.2 Prohibited Items
These items are forbidden onboard:
- Bottles made of glass
- Controlled substances that are illegal
- Guns or other types of weapons
- Pets, except when given prior authorization
6.3 Conduct
Passengers are expected to behave respectfully. We retain the right to end a charter prematurely without any reimbursement if a passenger’s conduct is seen as a risk to safety or disturbing to others.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to what you have paid for your charter. We are not accountable for:
- Injuries incurred due to passenger negligence
- Theft or damage to personal effects
- Indirect or punitive damages or any losses that follow as a consequence
- Delays caused by the weather or situations out of our control
7.2 Insurance Coverage
Our insurance is comprehensive, covering our fleet and operations. Passengers should secure their travel and personal insurance.
7.3 Assumption of Risk
By engaging in our charter activities, you accept that there are natural risks associated with maritime activities and you accept responsibility for your personal safety and security.
8. Modifications and Itinerary Changes
We retain the right to alter itineraries, routes, or schedules because of weather issues, safety concerns, or operational necessities. We will make all efforts to provide a comparable alternative when changes are made.
9. Force Majeure
We cannot be held responsible for delays, cancellations, or changes brought on by events out of our control, including but not restricted to:
- Severe weather conditions
- Calamities related to nature
- Regulations imposed by the government
- Port shutdowns
- Failures of the mechanical sort
10. Privacy and Data Protection
Your personal data is processed according to our Privacy Policy. Utilizing our services means you agree to the collection and use of your information as specified in the Privacy Policy.
11. Intellectual Property
The content housed on our website, including text, images, and logos, is under copyright and trademark protection. Reproducing, distributing, or making derivatives without our express consent is prohibited.
12. Governing Law
These Terms are subject to the laws of Germany. Any disputes will be settled in the courts of Hamburg, Germany.
13. Changes to Terms
